TY - JOUR AU - Rocha, Carina Amaral Fleury da AU - Studart, Lucia PY - 2019/08/27 TI - A LAICIDADE DO ESTADO DEMOCRÁTICO BRASILEIRO E A EUTANÁSIA NO ORDENAMENTO JURÍDICO JF - Episteme Transversalis; v. 10 n. 2 (2019): DIREITO E ÉTICA EM QUESTÕES CONTEMPORÂNEAS KW - N2 - Resumo O presente estudo tem por objetivo fazer uma análise profunda sobre a possibilidade de inserção da prática da eutanásia no ordenamento jurídico brasileiro, visto que, atualmente, não possui amparo legal pelo Estado. Busca-se analisar se a falta de previsão sofre influência de aspectos religiosos – altamente invocados pela própria sociedade – questionando-se, portanto, a laicidade do Estado, a qual é expressamente prevista na Carta Magna do país. Visa observar o papel do Estado ao longo da evolução humana, comparando-o, inclusive, com a realidade de outros países na esfera penal e social, abordando alguns de seus textos legais e acontecimentos contribuintes para a adoção de tal procedimento. Ainda, objetiva-se analisar o que comumente não se discute no âmbito do Direito Constitucional, encarando a morte não como algo a ser evitado, mas como um direito a ser perseguido diante de certas circunstâncias. Finalizando o estudo, nas considerações finais, conclui-se uma posição de interferência quanto à atuação do Estado nas garantias individuais inerentes ao sujeito de direito que fere o real conceito da dignidade da pessoa humana. Abstract This study deeply analyzes the possibility of inserting the practice of euthanasia in the Brazilian legal system, since it currently has no legal protection by the State. It seeks to analyze whether the lack of foresight is influenced by religious aspects - highly invoked by society itself - thus questioning the secularity of the state, which is expressly provided for in the country's Magna Carta. It aims to observe the role of the State throughout human evolution, comparing it, even, with the reality of other countries in the penal and social sphere, addressing some of its legal texts and contributing events for the adoption of such procedure. Still, the objective is to analyze what is not commonly discussed under Constitutional Law, seeing death not as something to be avoided, but as a right to be persecuted in the face of certaincircumstances. Concluding the study, in the final considerations, it concludes a position of interference as to the State action in the individual guarantees inherent to the subject of law that hurts the real concept of the dignity of the human person.
