TY - JOUR AU - Ribeiro, Anderson Luiz AU - Ribeiro, Carlos Barbosa AU - Naves, Raphael de Andrade PY - 2022/12/22 TI - ANÁLISE DA ADI 6764/DF SOB A ÓTICA DO PROCESSO JURISDICIONAL BRASILEIRO JF - Episteme Transversalis; v. 13 n. 3 (2022): ENGENHARIAS: Pesquisas e Projetos KW - N2 - No contexto da pandemia de COVID-19, o Presidente da República ajuizou, perante o Supremo Tribunal Federal, a ação direta de inconstitucionalidade (ADI) 6764/DF, impugnando decretos expedidos por governadores de estados que haviam determinado a adoção de medidas restritivas, como o fechamento de atividades não essenciais e toque de recolher. Sob a ótica das normas que regem o processo constitucional brasileiro, o presente estudo faz uma breve discussão sobre a decisão monocrática proferida pelo relator, Ministro Marco Aurélio de Mello, o qual indeferiu a petição inicial. Assim, buscou-se apoio metodológico na legislação, na doutrina e na jurisprudência, com o propósito de apresentar os principais aspectos técnicos de tal ação constitucional e promover discussão sobre a aderência – ou não – de tal decisão ao posicionamento historicamente adotado pela Suprema Corte. Por fim, concluiu-se que a decisão monocrática desrespeitou as normas fundamentais do processo jurisdicional brasileiro, afastando-se das interpretações anteriormente exaradas pelo Supremo Tribunal Federal. Abstract In the context of the COVID-19 pandemic, the President of the Republic filed a direct action of unconstitutionality (ADI) 6764/DF in the Federal Supreme Court, challenging decrees issued by state governors that had determined the adoption of restrictive measures, such as the closure of non-essential activities and curfews. From the perspective of the norms that govern the Brazilian constitutional process, the present study makes a brief discussion about the monocratic decision rendered by the rapporteur, Minister Marco Aurélio de Mello, who rejected the initial petition. Thus, methodological support was sought in legislation, doctrine and jurisprudence, with the purpose of presenting the main technical aspects of such constitutional action and promoting discussion about the adherence - or not - of such decision to the position historically adopted by the Supreme Court. Finally, it was concluded that the monocratic decision disrespected the fundamental norms of the Brazilian judicial process, moving away from the interpretations previously issued by the Federal Supreme Court.
