O presente artigo tem como finalidade conhecer o Instituto “adoção à brasileira”, tal fato ocorre quando uma mulher e/ou um homem se declaram pais biológicos dos filhos de outrem, registrando-os como sendo seus, cometendo assim, crime conforme previsto no código penal brasileiro. Deparamos com uma problemática que tem desafiado os tribunais brasileiros, devido ao fato, de que as decisões têm apontado para o melhor interesse da criança e do adolescente, indo à discordância com a lei. Para melhor compreensão analisaremos a evolução do Instituto da adoção, bem como da adoção à brasileira, o princípio do melhor interesse da criança e do adolescente, o vínculo socioafetivo, assim como, os entendimentos dos tribunais em relação à “adoção à brasileira”.

Abstract
The purpose of this article is to know the "Brazilian sweetness", this occurs when a woman and / or a man declare themselves biological parents of the children of others, registering them as their own, thus committing a crime as foreseen in Brazilian criminal code. We face a problem that has challenged the Brazilian courts, due to the fact that the decisions have pointed to the best interest of the child and the adolescent, going in disagreement with the law. For a better understanding, we will analyze the evolution of the Institute of adoption, as well as the adoption of the principle of the best interest of the child and adolescent, the socio-affective bond, as well as the courts' understandings regarding "Brazilian adoption."
