O presente trabalho tem como objetivo elucidar sobre a questão da recusa ao uso de transfusões sanguíneas por parte das Testemunhas de Jeová, em contrapartida com o direito à liberdade religiosa garantida pela Constituição Federal de 1988, em seu artigo 5º. Trás como escopo a Teoria do filósofo e doutrinador do Direito Ronald Dworking, sobre a ponderação entre princípios fundamentais, uma vez que em casos onde há um conflito aparente de direitos constitucionais se faz necessário o uso do juízo de ponderação entre os bens envolvidos e o sacrifício mínimo dos direitos, sendo para tal, importante a utilização de critérios que levem em conta a Supremacia da Dignidade Humana. Não é objetivo de este artigo firmar um posicionamento favorável ou contrário à referida religião, nem tão pouco adentrar para os motivos pelos quais levam os seus adeptos a esta decisão, sendo o presente, portanto, voltado apenas para as formas de ponderação entre os princípios constitucionais.

Abstract
The purpose of this paper is to elucidate the question of the refusal of the use of blood transfusions by Jehovah's Witnesses, in counterpart with the right to religious freedom guaranteed by the Federal Constitution of 1988, in its article 5. As the scope of the Theory of Ronald Dworking, philosopher and doctrine of law, on the balance between fundamental principles, since in cases where there is an apparent conflict of constitutional rights, it is necessary to use the judgment of weighting between the goods involved and the sacrifice minimum of rights, and for that, it is important to use criteria that take into account the Supremacy of Human Dignity. It is not the purpose of this article to establish a position favorable or contrary to the aforesaid religion, nor to enter into the motives by which its adherents take this decision, and the present, therefore, is directed only to the ways of weighing constitutional principles.
