Acompanhando as mudanças sociais e econômicas ao longo do tempo, a família do século XXI não é a mesma do passado. Hoje, diversos formatos familiares são reconhecidos e formados com base no afeto e na união. Assim, as leis que regem a sociedade devem acompanhar estas mudanças e regular as novas situações que surgem – incluindo o caso de famílias que optam por gerar filhos através de reprodução assistida. O presente artigo opta por trazer luz aos casos de inseminação artificial heteróloga, onde um terceiro alheio à relação familiar (o doador de sémen) é parte essencial do procedimento. Num olhar próximo, é possível enxergar os direitos garantidos àquele, mas os direitos dos filhos gerados por esta técnica ainda não são observados. Desta forma, uma análise é necessária para encontrar um equilíbrio nesta relação e entender como as leis se aplicam – ou não – neste caso.
Abstract
Along with the social and economic changes through time, the 21st century familyis not the same from the past. Nowadays, various family types are known andformed on affection and unity. Therefore, the laws that regulate society must follow these changes and regulate new situations that come up – including the case of families that choose to have children by assisted reproduction. This paperbrings to lightthe cases of artificial insemination, where another person outside the family relationship(the sperm donor)is an essential partof the procedure. In a closer look, it is possible to seethe rights ensured to the donor, but the rights of the children born by insemination aren’t guaranteed. Therefore, an analysis is needed to find a balance in this relation and understand how laws are applied – or not – in this case.
