O artigo apresenta, por meio de uma elucidação histórica e legal, o direito à educação e do dever de educar. Como parâmetro, destaca-se a Constituição Federal de 1988, a Lei de Diretrizes e Bases da Educação Nacional e o Estatuto da Criança e do Adolescente. O objetivo desse artigo é apresentar informações contundentes sobre a legalidade e a realidade do tema proposto. Partindo do pressuposto que todos são iguais perante a lei, aborda a obrigatoriedade do ensino brasileiro, a participação do Estado e a contribuição participativa da família. Trata-se de um estudo documental que utilizou, além da legislação vigente como fonte, procedimentos de pesquisa bibliográfica. O estudo apontou a importância de o educador aprofundar os conhecimentos jurídicos alusivos à educação para instruir seus educandos na aplicabilidade de seus direitos e, consequentemente, seus deveres.
Abstract
The article presents, through a historical and legal elucidation, the right to education and the duty of educating. As a parameter, stand out the Federal Constitution of 1988, the Law of Guidelines and Bases of National Education and the Statute of the Children and Adolescent. The purpose of this article is to present bruising information on the legality and reality of the proposed theme. Based on the assumption that All persons are equal before the law, it Addresses the obligation of Brazilian education, the participation of the State and the participatory contribution of the family. It is a documentary study, which used in beyond to the legislation in force as a source, procedures bibliographic research. The study pointed out the importance of the educator to deepen the legal knowledge alluding to education to instruct its students in the applicability of their rights and, consequently, their duties
