TOMBAMENTO DO PATRIMÔNIO HISTÓRICO NO BRASIL

Uma abordagem jurídica e cultural

Résumé

O presente artigo aborda a preservação do patrimônio cultural no Brasil e dentro deste contexto questiona-se o que de fato deve ser preservado, e de que forma podemos salvaguardar a nossa própria história. Visto que, o país evidencia grande heterogeneidade cultural. Contudo, verificamos que o tema, apesar de não ser novo, possibilita através da legislação questionar a forma conduzida dos processos do tombamento. Pois, o Bem Tutelado deve ser protegido tanto pelo Estado, quanto pela sociedade. A Constituição Federal de 1988 veio positivar esses direitos fundamentais juntamente com as leis especificas de tombamento e preservação, e uma delas é a lei nº 25 de 1937. É partindo dessa premissa que o presente trabalho apresenta e aponta crescentes e inequívocos casos de desarmonia dentro do processo de tombamento, com protagonismo inegável do poder do Estado.

Abstract

The present article addresses the preservation of the cultural heritage in Brazil, and with this context, it is questioned what must be preserved and how we can save our history since the country shows vast cultural heterogeneity. But we can verify that the theme, although not new, make it possible through legislation to question the conduct of the processes of tipping since the Protected Good must be protected by both the State and society. The Federal Constitution of 1988 came to affirm these fundamental rights together with the specific laws of tipping and preservation, and one of them is the law nº 25 of 1937. It is based on this premise that the present work presents and points out increasing and clear cases of disharmony within the process of tipping, with an undeniable showing of the power of the State.
